The five-foot fix: anatomy of a noncombustible fence transition
The short version
- California's adopted Zone 0 regulation (approved August 19, 2026, not yet in effect) requires a five-foot noncombustible span wherever a fence or gate attaches to a home, or comes within one foot of touching it.
- Every piece of that span counts: panel, posts, footing, gate frame, hardware, and the attachment itself. A metal panel on a wood post fails the intent.
- You keep the rest of your wood fence. The regulation does not require wholesale replacement, and repairs to an existing wood fence may use wood.
- Where the piece that meets the house is a gate (a situation the Board's staff memo singles out), the gate is the natural unit to retrofit.
- Nothing is required statewide yet. Once the regulation is effective, fences are a Phase 2 item for existing homes, with a multi-year runway.
What a transition span is
The "5 foot noncombustible fence section" you may have heard about has a proper name: a transition span. It is the short stretch of fence closest to the house, rebuilt in materials that cannot burn. A wood fence that touches the house is a fuse. Cut the last five feet and a fence fire has nowhere to go.
The statewide Zone 0 regulation the Board of Forestry approved on August 19, 2026 puts it this way in the Local Responsibility Area track (LRA, land protected by cities and counties), at §1298.04(b). The fence provisions are unchanged from the July 2026 draft:
(8) Combustible fences and gates shall not be attached to an Occupied Structure.
(9) Fences. (A) All fences and gates that are attached to an Occupied Structure, or come within one (1) foot of contact with an Occupied Structure, shall have a five (5) foot Noncombustible span from the point of attachment or the point closest to the Occupied Structure. (B) After the effective date of this regulation, no new Combustible fences or gates (whether attached or parallel to the Occupied Structure) are permitted within five (5) feet of an Occupied Structure. (C) Fence repairs to an existing Combustible fence may be made using Combustible replacement materials.

The State Responsibility Area track (SRA, land where the state has fire protection responsibility) covers the same ground in different words. Its fence rule, §1299.03(d)(9), is one undivided paragraph, it says "Building or Structure" where the LRA track says "Occupied Structure", and it carries no clause about parallel fencing:
(9) All fences and gates that are attached to a Building or Structure, or come within one (1) foot of contact with a Building or Structure, shall have a five (5) foot Noncombustible span from the point of attachment or the point closest to the Building or Structure. After the effective date of this regulation, no new Combustible fences or gates are permitted within five (5) feet of a Building or Structure. Fence repairs to an existing Combustible fence may be made using Combustible replacement materials.

So the five-foot span at the attachment point and the repair allowance apply in both tracks. The explicit reference to fencing that runs parallel to the structure appears only in the LRA text, which covers Very High Fire Hazard Severity Zones.
To be clear about status: the Board approved this regulation on August 19, 2026, and it is not yet in effect. The package still needs Office of Administrative Law review, including a five-day public comment period, and publication by the Secretary of State. Staff said they would file an emergency rulemaking package and expected the rules "could become effective as early as September 2026." How to measure your five feet
Zone 0 is the ember-resistant zone: the first five feet measured outward from a structure. You measure from the exterior wall, and also from an attached deck, stairs, or pergola, which count as part of the structure under the adopted definition even when they are built of noncombustible materials. A noncombustible patio is the one attached feature the definition excludes. The zone extends five feet out, or to the property line, whichever comes first.
For the fence rule specifically, there are two triggers worth reading carefully:
- The attachment trigger. If a fence or gate is attached to the house, or comes within one foot of touching it, the regulation requires a five-foot noncombustible span from the point of attachment, or the point closest to the house. A fence that stops an inch short of your siding is treated the same as one bolted to it.
- The new-fence trigger. After the effective date, no new combustible fence or gate will be permitted within five feet of the structure. In Very High Fire Hazard Severity Zones inside a Local Responsibility Area, the text spells out that this covers fencing running parallel to the house as well as fencing running into it.
Measure from the house side: hook a tape on the wall (or the edge of the attached deck or stairs) and run it out five feet along the fence line. Everything inside that tape is the transition span. Not sure whether the rule would reach your property at all? Start with does Zone 0 apply to my home.
Every component has to pass, not just the panel
Under the adopted regulation, "noncombustible" has a precise meaning: materials that pass ASTM E136, a vertical tube furnace test at 750 °C that measures whether the material itself can burn or add fuel. In practice, what passes: aluminum, steel, wrought iron, chain link, masonry, concrete, and stone. What does not pass: wood, vinyl, composite, fire-retardant treated wood (FRTW, lumber pressure-treated with fire retardants), and fire-rated coatings.
The mistake to avoid is thinking of the span as a panel swap. The intent is that no combustible material bridges the transition, so check every piece:

One more thing before you shop: no fence-assembly fire test exists in US code, so no fence product can honestly be called "certified fire-resistant" as an assembly. A "Class A" rating comes from ASTM E84, a tunnel test designed for interior finishes, not a wildfire fence standard. Verify the material itself. Why the gate is the natural retrofit unit
Often the piece that actually meets the house is a gate. The Board's own staff, in their July 2026 memo, framed the retrofit around exactly that situation:
The purpose of the regulations is not to require wholesale replacement of existing wood fences. Existing combustible fences may remain, repairs using existing materials may continue, and only where an attaching combustible gate exists or a fence is fully replaced would the applicable Zone 0 standards apply.

Replace a wood gate and its frame with a metal one, carry noncombustible material out to the five-foot mark, and the attachment problem is solved while the rest of the fence stays put. The California Department of Insurance makes the case for why this one junction matters: "Replacing wood fencing connecting to your home with metal is critical because it can act like a candle wick leading fire straight to your home."

Say it plainly, because plenty of copy implies otherwise: the regulation does not require you to replace your wood fence. Existing combustible fences may remain, and Board staff wrote that "Fences more than five feet from the structure are not impacted by the draft regulation." How the situations sort out under the adopted regulation:

The repair-versus-replace line matters. Fixing a few pickets or a rotted rail on an existing wood fence? The regulation explicitly allows combustible replacement materials. DIY or contractor?
A five-foot transition is a small job by fencing standards: a short span of metal panel and posts, or a gate kit, at the side of the house. The honest considerations cut both ways.
- DIY makes sense when the run is short and level, you are comfortable setting posts in concrete, and the gate is a standard size. The component checklist above is your spec sheet. The panel is the easy part; the posts, footing, and hardware are where DIY installs quietly fail the intent.
- A contractor makes sense when the transition involves slopes, masonry attachment to the house, or a custom gate that has to hang square and stay square. If a local Zone 0 ordinance is already in force where you live (six jurisdictions have one, from Laguna Beach to Berkeley), confirm the specifics with your local fire agency. Either way, check with your local building department about whether your project needs a permit. That varies by jurisdiction, and we will not pretend otherwise.
Photograph it before and after
The aerial imagery and risk models insurers commonly rely on generally cannot see a fence. If you want the improvement counted, you have to document it. Since October 14, 2022, California's Safer from Wildfires regulation (10 CCR §2644.9) has required insurers that price on wildfire risk to offer a rating credit for noncombustible materials, including fences and gates, within five feet of the home; on carrier mitigation forms, that fencing measure appears first of twelve. It is a credit insurers must offer, not something any insurer requires of you.
Before you touch anything, photograph:
- The attachment point: where the fence or gate meets the wall, close up and wide.
- The full span with a tape measure visible from the wall to the five-foot mark.
- The existing posts, footing, and hardware.
After the work, repeat the same shots from the same angles, and keep material receipts that identify what was installed. What this means for you
- Today, as of August 19, 2026: no statewide rule requires a transition span yet. The Board of Forestry approved the regulation on August 19, 2026, but it does not bind anyone until the Office of Administrative Law finishes its review and the Secretary of State publishes it. Staff expected that could happen as early as September 2026.
- If you live in a jurisdiction with its own ordinance (Moraga-Orinda, Ventura County Fire Protection District, Laguna Beach, Auburn, Berkeley's covered zones, or San Diego), local rules are already in force and have their own terms. Confirm with your local fire agency.
- Once the regulation takes effect: for existing homes, fences and gates are a Phase 2 item: within 3 years of the effective date, or up to 5 years on a timeline set by the local fire agency. New construction has to comply on the effective date. Details in our timeline and enforcement guide.
- If your gate is due for replacement anyway, going noncombustible now anticipates the adopted requirement and meets the §2644.9 noncombustible-materials measure your insurer must credit. Photograph before you start.
- What you do not need to do: replace the whole wood fence. Nothing in the regulation requires it.
Frequently asked questions
Do I have to replace my entire wood fence?
You do not. Under the regulation approved August 19, 2026, which is not yet in effect, existing combustible fences may remain, and repairs to them may use combustible materials. The five-foot noncombustible span applies only where a fence or gate attaches to the home or comes within one foot of it, where a fence is fully replaced within Zone 0, or for new fences within five feet.
What materials count for a 5 foot noncombustible fence section?
Under the regulation's ASTM E136 definition: aluminum, steel, wrought iron, chain link, masonry, concrete, and stone pass. Wood, vinyl, composite, fire-retardant treated wood, and fire-rated coatings do not.
My fence runs close to the house but never touches it. Is it covered?
If it comes within one foot of contact, the regulation treats it like an attached fence and requires the five-foot span from the point closest to the house. An existing fence that passes through Zone 0 without attaching may remain. After the effective date, any new combustible fence within five feet will be prohibited; in Very High zones inside a Local Responsibility Area, the text says so explicitly for parallel fencing as well.
Can I just buy a "fire-rated" or "certified fire-resistant" fence?
No such certification exists. There is no fence-assembly fire test in US code, so no fence product can honestly carry that claim. "Class A" ratings come from ASTM E84, an interior-finish tunnel test, and are not a substitute for noncombustible materials. Verify the material, not the marketing.
When would the transition-span requirement take effect?
It is not in effect statewide. The Board of Forestry approved the regulation on August 19, 2026; it still needs Office of Administrative Law review and publication by the Secretary of State, and staff expected it could become effective as early as September 2026.
